Datawind, maker of Aakash tablet, alleges Quad violated agreement, serves notice

Datawind, the maker of the world's cheapest tablet Aakash, today said has the copyright of the tablet, and alleged that a contract manufacturer Quad Electronics was violating his right by signing a direct agreement with IIT-Rajasthan for development of the device.

"Datawind the team within developed Aakash and sub-contracted the assembly of Aakash Tablet to Quad Electronics based on his own design. Therefore, the intellectual property rights of the tablet belongs to Datawind" Datawind CEO Suneet Singh Tuli said in a statement today.

He stated that Quad had signed non-disclosure agreement and manufacturing services agreement confirming this.

"Quad Electronics broke Datawind the intellectual property, circumvented his relationship with IIT-Rajasthan, signed a direct mou (memorandum of understanding) with them to develop the next generation device, and then sell their inventory on the open market," Tuli said.

Quad Electronics and IIT-Rajasthan did not respond to e-mails sent for comments.

Tuli said that Datawind sent a notice to the company and to approach the court against the violation of an agreement of Quad Electronics. "We have served notice, and to present in court if it can not be solved," he said.

Datawind said that the company paid a Quad Electronics for all units delivered to Datawind, in addition to the 600 units that remain unpaid from IIT-Rajasthan.

"Datawind the counter claim against Quad exceeds any amount due to them. There is not a payment for Quad, contrary to their allegations," Tuli said.

It was reported that Quad executive was alleged that payment is due and has served a legal notice to Datawind.

Tuli said he is working on the second generation of the Aakash tablet and Telecom Minister Kapil Sibal announced in Parliament that DataWind will supply 1 lakh Aakash tables through IIT-Bombay.

"In response to concerns tardy customer response. Datawind would like to state that their toll-free number works - but since it receives nearly 40,000 calls per day, is often logjam resulting in an incomplete call," he said.

Tuli added that any person who has made a deposit, it is answered within 48 hours of receipt of payment and is provided with a specific e-mail address and a specific phone number to call for consultations, instead of the toll-free number.
